Edmonds City Council Tuesday to focus on whether study session format is working

Among the items to be discussed during Tuesday night’s Edmonds City Council study session is whether the study session format itself — which in September 2014 replaced the former council practice of holding separate committee meetings to study issues — is working.

Elements to be discussed Tuesday night include: study session meeting start time, configuration of tables, the ability of those watching the meeting to hear councilmembers (a problem because some councilmembers/presenters don’t speak into the microphone and/or the microphones themselves often fail), assurance that all study session presentations are available for the public to see, the format for councilmember questions, and the length of time set aside for discussions.

Also on the agenda are discussions regarding:

– the proposed 2015 Comprehensive Plan Update

– the Development and Critical Area Codes

– a professional services agreement with BHC for the 2016-2017 Sanitary Sewer Replacement Projects

– an update on Highway 99 Planning

– the construction contract award for the Southwest Edmonds – 105th/106th Avenue West Storm Improvements Project

– final construction costs and a recommendation for acceptance of the 2014 Watermain Replacement Project

– reports on outside boards and committees

The council is also scheduled to convene in executive session regarding pending or potential litigation, with potential action as a result.

The meeting will begin at 7 p.m. in the Council Chambers, Public Safety Complex, 250 5th Ave. N., Edmonds. You can see the complete agenda here.

  1. I imagine many citizens have noticed the City Council move to extend the length of City Council Meetings at 10:00 P.M. They do so because ECC 1.04.010 includes the following:

    “Council meetings shall adjourn at 10:00 p.m. on the day initiated unless such adjournment is extended by an affirmative vote of a majority of the council as a whole plus one.”

    ECC 1.04.010 also includes the following:

    “Committee meetings of the council shall be held in conjunction with work meetings of the council at such times and in accordance with such procedures as the council and its respective committees shall establish.”

    Despite this, the Council has failed to hold the required Committee Meetings since last September – a direct clear violation of the Code. I am pretty certain that we currently do not have “respective committees”.

    Making it worse, ECC 1.020.031 requires City Council Presidents to do the following:

    “Make assignments to all council committees, schedule committee hearings, and otherwise supervise the committee system”

    Our City Council Presidents have been violating E.C.C 1.02.031 for many months by failing to do so.

    Even though I have brought this to the attention of the City Council on numerous occasions, nothing has been done. It is as if they think they have the ability to pick and choose which laws they follow and don’t follow. We just witnessed this again on June 2nd when they violated a clear State law that required a public hearing to be held within 60 days – they acted as if 77 days was okay.

    This Tuesday night’s Agenda Packet fails to provide the two critical sections of the Edmonds City Code as Attachments to the related agenda item – ECC1.02.031 and ECC 1.04.010. How hard would it have been to include these two Code Sections in the Agenda Packet?

  2. This could have easily been addressed by passing a new Ordinance – something the Council voted to do last September 2nd. However, the related Ordinance was never done.

    From August 26, 2014 Meeting Minutes:

    Although the exact details do not have to be included in the code, if the Council chooses this format, some minor amendments to the code will be necessary. If the Council is interested in this format, she suggested providing direction to the City Attorney to craft an ordinance for consideration at a future meeting.

    September 2, 2014 Main Motion:

    COUNCIL PRESIDENT PRO TEM JOHNSON MOVED, SECONDED BY COUNCIL PRESIDENT BUCKSHNIS, TO DIRECT THE CITY ATTORNEY TO CREATE AN ORDINANCE TO BRING BACK TO THE CITY COUNCIL TO AUTHORIZE STUDY SESSIONS FOR THE COUNCIL’S FUTURE FORMAT SO THAT THERE WOULD BE TWO BUSINESS SESSIONS AND TWO STUDY SESSIONS PER MONTH.

    From September 2, 2014 Meeting Minutes:

    For Mayor Pro Tem Buckshnis, Mr. Taraday explained the motion directed him to prepare an ordinance. The Council did not need to wait until the effective date of the ordinance to implement the new process. Under the current code, the Council has four meetings per month; the Council can decide to the two of the meetings be study sessions and two be business meetings.

  3. They should also consider making 15.00/hr the minimum wage for all who work in Edmonds..like Seattle, Seatac, etc.

    After all, that is the fair and right thing to do…
