Daniel Lavely, a seven-and-a-half year employee of the Edmonds Police Department, was booked into the Snohomish County Jail in Everett Thursday for allegedly having sex in his patrol car last month with a 28-year-old woman he had stopped earlier in the day for jaywalking.
According to information sent Thursday by both the Edmonds and Everett police departments, on May 7, Lavely released the woman after initially stopping her for jaywalking on Highway 99 in Edmonds. The 46-year-old Lavely contacted her later that evening on an unrelated call and allegedly took her into temporary custody, put her in his patrol car and drove to a remote location, where they had sex. A few days later the woman reported the incident to law enforcement.
Everett police investigated the incident at the request of Edmonds police, and arrested Lavely Thursday morning.
Lavely faces a charge of first-degree custodial sexual misconduct. He was immediately placed on administrative leave and his law enforcement authority was suspended, police said. Formal criminal charges are expected to be filed by the Snohomish County Prosecuting Attorney.
According to a 2010 My Edmonds News story, Lavely was commended by the City for his quick actions in apprehending two suspected burglars.
