Former Edmonds cop accused of having sex on duty will testify next week

Former Edmonds police officer Daniel Lavely is expected take the stand in his own defense next week.

Lavely is accused of sexual misconduct stemming from an incident last May in which prosecutors allege that he had sex in his patrol car with a woman he had earlier picked up for jaywalking. The 48-year old Lavely was placed on administrative leave in May, 2012, and resigned in January of this year.

Lavely joined the Edmonds Police Department in 2004.

His trial is currently underway in Snohomish County Superior Court. His alleged victim has already testified that on the night in question Lavely detained her and then drove her to a deserted parking lot near the Burlington Coat Factory on Highway 99 where he fondled her and had sex with her.

It is a crime for an officer on duty to engage in sex with a person he/she is detaining, even if that sex is consensual.

Lavely maintains his innocence, and is expected to testify that he did not have sex with the woman, but rather that she propositioned him and he refused.

“We expect Mr. Lavely to take the stand on Monday,” said Anna Clark, Snohomish County Superior Court legal assistant. “Several other witnesses are scheduled to testify however, which may delay Lavely’s testimony until later in the week.”
