The Washington State Court of Appeals earlier this week upheld the 2013 conviction of a former Edmonds police officer for having sex with a woman he had detained.
In August 2013, Daniel Lavely, an Edmonds police officer since 2004, was convicted by a Snohomish County jury of first-degree custodial misconduct for having sex with a woman he had taken into custody. Lavely denied the accusation, but the jury — after hearing two weeks of testimony and deliberating for two-and-a-half days — found the evidence sufficient to bring in a guilty verdict. In the recent appeal, attorneys for Lavely argued that the evidence was insufficient to support a conviction on that charge, and that the prosecutor’s manner of vouching for the victim prejudiced the jury and amounted to prosecutorial misconduct.
The State Court of Appeals disagreed on both points, upholding the earlier conviction.
Good. I believe this police officer raped this woman in his custody. He should be convicted and he should not be allowed to serve as a police officer ever again.
